Store Terms

Purchases are made through our online store at shop.everdrive.pro. The following additional terms apply to purchases:

  • All prices are in US dollars.
  • We reserve the right to refuse or cancel orders at our discretion, including orders that appear fraudulent or abusive.
  • Product availability is subject to change without notice.
  • In the event of a pricing or typographical error, we may cancel affected orders and issue a full refund, even after an order confirmation has been sent.
  • We strive for accuracy in product descriptions, but we do not warrant that descriptions, images, or other content are error-free. If a product is not as described, your remedy is to return it under the Shipping and Returns policy.
  • Products are sold for personal use only and may not be purchased for resale without our prior written consent.

Subscriptions and Auto-Renewal

If we offer subscription purchases, the renewal cadence and price will be disclosed clearly before you subscribe. Subscriptions renew automatically until canceled. You can cancel online from your account at any time; to avoid being charged for the next renewal, cancel at least 24 hours before the renewal date. These terms apply only if and when you purchase a subscription.

SMS and Mobile Messaging

If you opt in to text message updates or marketing, the following applies. Consent to receive marketing texts is not a condition of any purchase. Message frequency varies, and message and data rates may apply; carriers are not liable for delayed or undelivered messages. Reply STOP to cancel at any time and HELP for help. If you change or deactivate your phone number, please update us so messages are not sent to a reassigned number.

Electronic Communications

By using this site or emailing us, you consent to receive communications from us electronically. You agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.

Reviews and Submitted Content

If you submit a review, photo, testimonial, or other content to us or through our store, you grant Everdrive a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, and display that content in connection with our products and marketing, with or without your display name. You represent that your content is accurate, is your own, and does not violate any third-party rights. We do not accept or consider unsolicited product ideas or proposals, and no confidential relationship is created by sending them.

Disclaimer of Warranties

THE SITE, ITS CONTENT, AND OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE NOT PERMITTED BY LAW. This does not affect the refund rights described in the Shipping and Returns policy.

Limitation of Liability

To the fullest extent permitted by law, Everdrive is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or our products. Our total liability for any claim related to the site or a product purchase will not exceed the greater of the amount you paid for the product in question or fifty US dollars ($50).

Indemnification

You agree to defend, indemnify, and hold harmless Everdrive, myMomentum LLC, and their officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these terms, your misuse of the site or products, or content you submit.

This site may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites. Links do not imply endorsement.

Dispute Resolution and Arbitration

Before filing any formal claim, you agree to first contact us via the contact page and give us 30 days to work toward an informal resolution.

If we cannot resolve a dispute informally, you and Everdrive agree that any dispute arising from these terms, the site, or a product purchase will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court.

YOU AND EVERDRIVE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER REPRESENTATIVE PROCEEDING. Claims may be brought only on an individual basis.

You may opt out of this arbitration provision by contacting us via the contact page within 30 days of your first purchase or first acceptance of these terms, stating your name and that you decline arbitration. Opting out does not affect any other part of these terms.

Termination

We may suspend or terminate your access to the site, or decline to serve an order, at our discretion, including for violation of these terms. Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

Governing Law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Subject to the arbitration provision above, any claims not subject to arbitration will be brought in the state or federal courts located in Delaware.

Accessibility

General

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. We are not liable for delays or failures caused by events beyond our reasonable control, including carrier disruptions, natural disasters, or governmental actions.
